New Litigation Guidance

The Charity Commission has published new litigation guidance for trustees. The guidance, CC38, provides a 16-point checklist designed to enable trustees to consider whether or not to take legal action.

The Commission argues that the guidance will help trustees to ensure that their decision-making is justified and sits in-line with proportionate risk management. However, concern has been voiced from across the sector about lack of consultation and the tone of the guidance. Read the guidance in full here.
